1. Definitions

In these Terms and Conditions, the following terms have the meanings set out below:

"Quietharbor", "we", "us", "our" — Quietharbor Enterprise, a business registered in Selangor, Malaysia, operating at 58 Persiaran Kayangan, 40100 Shah Alam.

"Programme" — any of the three service offerings made available by Quietharbor: the Group Information Session on Retirement Paperwork, the One-to-One Document Preparation Support, and the Annual Records Stewardship Plan.

"Participant" or "you" — any individual who books, attends, or enrols in a Programme, or who uses this website.

"Agreement" — these Terms and Conditions, together with our Privacy Policy and Cookie Policy, which together form the entire agreement between you and Quietharbor.

"Session materials" — the printed reference booklet, filing index, submission folder, digital archive, quarterly reminders, annual review, and family summary sheet produced in the course of a Programme.

2. Acceptance of Terms

By booking or attending a Programme, submitting an enquiry through this website, or using any part of this site, you confirm that you have read, understood, and agree to these Terms and Conditions.

You must be at least 18 years of age to participate in any Programme or enter into this Agreement. By booking, you confirm that you meet this requirement.

If you are booking on behalf of another person (for example, enrolling a parent in the Annual Records Stewardship Plan), you confirm that you have authority to enter into this Agreement on their behalf.

3. Description of Programmes

Quietharbor provides general education sessions, clerical document preparation assistance, and administrative organisation services in connection with retirement paperwork and pension records. All Programmes are conducted in English and are available to residents of Malaysia.

Programmes are delivered at our premises at 58 Persiaran Kayangan, 40100 Shah Alam, Selangor, or, where agreed in writing, at a location mutually convenient to both parties.

Nothing in any Programme constitutes financial advice, legal advice, tax advice, or any other form of regulated professional advice. Quietharbor is not a licensed financial planner, legal practitioner, or tax agent. Where a question raised in the course of a Programme requires a professional judgement, it will be noted in writing and referred to the appropriate body or professional.

4. Booking and Enrolment

Bookings are made by contacting Quietharbor by telephone, email, or the contact form on this website. A booking is confirmed when Quietharbor sends written confirmation of the date, Programme, fee, and participant details.

For the Annual Records Stewardship Plan, enrolment is confirmed by a written enrolment agreement and payment of the annual fee as set out in Section 7.

Quietharbor reserves the right to decline a booking where a prospective participant's stated requirements fall outside the scope of what Quietharbor offers.

5. Participant Responsibilities

Participants are expected to attend at the agreed time and location. Where a participant needs to reschedule, at least 48 hours' notice is required. Quietharbor will make reasonable efforts to offer an alternative date.

For the One-to-One Document Preparation Support, participants are responsible for bringing the original documents or copies they wish to work with. Quietharbor will not be responsible for documents that are lost, damaged, or left behind after a session.

Participants must not use Quietharbor's session materials, reference booklets, or other outputs for any commercial purpose, redistribution, or resale without prior written consent.

Participants must not request that Quietharbor staff make representations, provide assurances, or offer opinions about the participant's personal financial or legal entitlements. Any such request will be noted and referred appropriately.

6. Intellectual Property

All session materials, reference booklets, programme structures, and website content are the intellectual property of Quietharbor. By attending a Programme, participants receive a personal, non-transferable licence to use the materials provided for their own private purposes.

Documents brought to sessions by participants remain the property of the participant. Copies made for stewardship purposes are held on behalf of the participant and remain their property. These copies will be returned or securely deleted at the conclusion of the stewardship arrangement.

7. Payment Terms

Fees are stated in Malaysian Ringgit (RM) and are as follows:

  • Group Information Session: RM 480 per participant
  • One-to-One Document Preparation Support: RM 1,200 for three sessions
  • Annual Records Stewardship Plan: RM 4,300 per household per year

Payment is due in full before or at the time of the first session unless otherwise agreed in writing. For the Annual Stewardship Plan, payment is due in full at enrolment.

Cancellations: If a participant cancels at least seven calendar days before the first session, a full refund will be issued. Cancellations within seven days of the first session are not eligible for a refund, but Quietharbor will offer an alternative date where practicable. If Quietharbor cancels a session, a full refund will be issued or an alternative date offered.

All fees are inclusive of the materials specified for each Programme. There are no additional charges for reference booklets, filing indices, submission folders, digital archives, or family summary sheets.

8. Programme-Specific Terms

Group Information Session: The session covers general publicly available information only. Quietharbor does not review, interpret, or comment on any individual participant's documents during the session. Questions relating to individual circumstances will be noted and referred in writing.

One-to-One Document Preparation Support: The three-session engagement is designed to be completed within a three-month period unless otherwise agreed. The submission folder prepared in the sessions is for the participant to lodge themselves. Quietharbor does not submit any documents on the participant's behalf.

Annual Records Stewardship Plan: The plan runs for twelve calendar months from the date of the initial inventory. At the end of the twelve-month term, the arrangement expires unless renewed in writing. Quietharbor makes no assessment of the contents of any documents held under the plan. The plan is organisational in nature only.

9. Disclaimers

Quietharbor's Programmes are provided as general education and administrative organisation services. They are not a substitute for regulated professional advice. Participants are encouraged to raise any questions about their individual entitlements, obligations, or circumstances with a qualified solicitor, licensed financial planner, or the relevant government agency.

Quietharbor does not represent or warrant that the information shared in sessions is complete, current, or applicable to any participant's individual circumstances. All general information is drawn from publicly available sources and is subject to change.

Session materials and reference booklets are provided for general informational purposes only and do not constitute professional advice of any kind.

10. Limitation of Liability

To the maximum extent permitted by Malaysian law, Quietharbor's liability to any participant arising from or in connection with a Programme is limited to the total fee paid by that participant for the Programme in question.

Quietharbor is not liable for any indirect, consequential, or special loss arising from a participant's reliance on session content, the outcome of any document submission, or any action or inaction by a government agency in connection with a participant's paperwork.

Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence.

11. Indemnification

You agree to indemnify Quietharbor against any claim, loss, or expense (including reasonable legal costs) arising from your breach of these Terms or from any misuse of session materials or the website.

12. Termination

Either party may terminate the Annual Records Stewardship Plan arrangement by giving thirty days' written notice. In the event of termination by the participant, fees paid are non-refundable except for any full unused calendar months remaining, which will be refunded on a pro-rata basis.

Quietharbor may terminate any Programme arrangement immediately where a participant behaves in a manner that is abusive, threatening, or incompatible with the conduct of a session, or where a participant repeatedly requests services outside the scope of what Quietharbor offers.

Upon termination of a stewardship arrangement, all document copies held by Quietharbor will be returned to the participant or securely deleted within fourteen days, as the participant directs.

13. Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Malaysia. Any dispute arising from or in connection with these Terms is subject to the exclusive jurisdiction of the courts of Selangor, Malaysia.

Before commencing any formal proceedings, parties agree to attempt to resolve any dispute informally by contacting Quietharbor at [email protected]. Quietharbor will respond within fourteen days and endeavour to resolve the matter without recourse to legal proceedings.

14. General Provisions

Entire agreement: These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Quietharbor in relation to the Programmes and this website.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.

Waiver: Quietharbor's failure to enforce any right under these Terms does not constitute a waiver of that right.

Assignment: Participants may not transfer their rights or obligations under these Terms without Quietharbor's prior written consent. Quietharbor may assign its rights and obligations in connection with a business transfer or restructuring.

15. Changes to These Terms

Quietharbor may update these Terms from time to time. The date of the most recent revision is shown at the top of this page. For material changes, existing stewardship plan participants will be notified by email at least thirty days before the change takes effect. Continued participation in any Programme after a revision constitutes acceptance of the updated Terms.
